ElevaTrack Technologies Inc. – Terms of Use

1. Eligibility

The Services are intended only for authorised building managers or their delegates who are at least 18 years old (or the age of majority in their jurisdiction, if higher) and legally capable of entering into a binding contract on behalf of the relevant building or homeowners’ association.

2. Description of the Services

ElevaTrack provides an automated Telegram bot that allows building managers to grant or revoke elevator access permissions and to send safety or service notifications to tenants and maintenance staff via WhatsApp. ElevaTrack is not an emergency-response or life-safety system. In an emergency, always dial the local emergency number.

3. Acceptable Use

When using the Services you agree that you will not:

• Issue elevator permissions that violate building regulations, tenancy agreements, or applicable law;
• Misuse the bot to spam, harass or send unlawful or misleading communications;
• Upload or transmit malicious code or automated scripts to the Telegram or WhatsApp platforms;
• Reverse-engineer, decompile or attempt to extract the source code or underlying databases of the Services, except where expressly permitted by law;
• Attempt to bypass or impair any security measures we implement.

4. Messaging Integrations (WhatsApp & Telegram)

1. Opt-in. We send WhatsApp notifications only after the intended recipient has opted in, as described in our Privacy Policy.
2. Meta platform rules. You must comply with Meta’s and Telegram’s relevant business and community policies when sending messages via the Services.
3. Template messages. Any WhatsApp messages sent outside the 24-hour customer-service window use Meta-approved templates.
4. Third-party responsibility. Meta and Telegram are not responsible for the Services. Your use of those platforms is subject to their separate terms.

5. Data Storage & Security

All operational data—including identity details, elevator-permission records and message logs—is stored in secured Google Sheets workbooks located in Google’s EU datacentres. We implement access controls (Google Workspace sharing restrictions and two-factor authentication) to protect the integrity and confidentiality of that data. You must likewise keep any shared Google Sheets links or Telegram bot credentials confidential and restrict them to authorised personnel only.

6. Suspension & Termination

We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe that you have violated these Terms, created a security risk, or infringed the rights of others. Sections 7–10 survive any termination.

7. Disclaimers

1. As-is. To the fullest extent permitted by law, the Services are provided “as is” and “as available”.
2. No emergency functionality. The Services are not certified life-safety systems. Electronic communications may be delayed or fail.
3. Third-party networks. We are not responsible for outages, delays or failures caused by Telegram, WhatsApp or internet providers.

8. Limitation of Liability

To the maximum extent allowed by law, our aggregate liability arising out of or relating to the Services is limited to USD 100. We are not liable for any indirect, incidental, consequential or punitive damages, or for loss of profits, data or goodwill.

9. Indemnification

You will defend, indemnify and hold harmless ElevaTrack, its affiliates, officers, directors and employees from claims and liabilities arising out of or related to (a) your misuse of the Services or (b) your breach of these Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Palestine. We both agree to attempt to resolve disputes through good-faith negotiations; if unresolved within 30 days, disputes will be submitted to the exclusive jurisdiction of the courts of Nablus.

11. Changes to these Terms

Material changes will be announced via our Telegram channel or WhatsApp broadcast to building managers and posted on this page. Continued use of the Services after the “Last updated” date signifies acceptance of the revised Terms.
